Terms of Service

The rules and conditions that govern your use of the ScanScope portal and its content.

1. Acceptance of Terms

By accessing and using ScanScope (the "Site"), you accept and agree to be bound by and comply with these Terms of Service and our Privacy Policy. If you do not agree to abide by the foregoing, please do not use this service. We reserve the right to update these terms at any time without notice. Your continued use of the Site following any changes constitutes your acceptance of the new terms.

2. Site Use Licence

ScanScope grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, educational, and non-commercial purposes. This licence does not include the right to:

  • Reproduce, duplicate, copy, or sell any portion of the Site or its content
  • Modify, alter, or create derivative works based on Site content
  • Reverse engineer, disassemble, or decompile any software on the Site
  • Distribute, rent, lease, transfer, or sublicense the Site or its content to third parties
  • Use automated tools (bots, scrapers, spiders) to access or harvest data from the Site
  • Use the Site for commercial purposes without explicit written permission

3. Intellectual Property Rights

All content on the Site, including text, graphics, logos, RFC summaries, tutorials, images, videos, code examples, and software (collectively, "Content"), is the property of ScanScope or its content providers and is protected by international copyright, trademark, and intellectual property laws.

Content creators and RFC document authors retain rights to their original works. ScanScope provides curated summaries, annotations, and analysis. All such derivative works are owned by ScanScope.

You may view and print Content for personal educational use only. You may not republish, redistribute, or resell Content without explicit written permission from ScanScope.

4. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your username and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately if you suspect unauthorised access to your account.

You represent that all information you provide during registration is accurate, complete, and truthful. You agree to update information as needed to maintain accuracy. You may not create an account using false information or impersonate another person.

5. User-Generated Content

If you submit comments, reviews, contributions, or other content to the Site, you grant ScanScope a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, modify, and distribute such content. You represent that your submissions are original, do not infringe third-party rights, and do not violate any laws or regulations.

ScanScope is not obligated to publish or credit user-generated content but may do so at our discretion. We reserve the right to remove any content that violates these terms or is otherwise inappropriate.

6. Prohibited Conduct

You agree not to:

  • Use the Site for illegal purposes or in violation of any applicable laws or regulations
  • Harass, abuse, threaten, defame, or otherwise harm other users or ScanScope staff
  • Post hate speech, discriminatory content, or content promoting violence
  • Spam, flood, or engage in other disruptive behaviour
  • Phish, attempt to gain unauthorised access, or compromise Site security
  • Use the Site to distribute malware, viruses, or other harmful code
  • Circumvent access restrictions or attempt to bypass security measures
  • Sell, trade, or transfer your account or access rights to third parties
  • Engage in any form of fraud, misrepresentation, or deception

7. Limitation of Liability

To the fullest extent permitted by applicable law, ScanScope and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Site, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, even if ScanScope has been advised of the possibility of such damages.

In jurisdictions that do not permit the exclusion of implied warranties, ScanScope's liability for breach of any implied warranty is limited to the fees you paid for the applicable service in the 12 months preceding the breach, or if no fee applies, $100.

8. Disclaimer of Warranties

The Site and all Content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. ScanScope disclaims all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party intellectual property rights
  • Accuracy, completeness, or reliability of Content
  • Absence of viruses or malicious code
  • Uninterrupted availability or operation of the Site

While we strive for accuracy in RFC summaries and tutorials, we do not warrant that all information is error-free. Network configurations and technical details should be verified in your specific environment before deployment.

9. Third-Party Links and Services

The Site may contain links to third-party websites and services that we do not control or operate. We are not responsible for the content, accuracy, availability, or practices of external sites. Your access and use of such sites is at your own risk and subject to their terms and conditions.

10. Indemnification

You agree to indemnify, defend, and hold harmless ScanScope, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, and licensees from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

11. Modification and Discontinuation of Services

ScanScope reserves the right to modify, suspend, or discontinue any part of the Site at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of services.

12. Termination of Access

ScanScope may terminate or suspend your account and access to the Site at any time, with or without cause or notice, if you violate these Terms or engage in prohibited conduct. Upon termination, your right to use the Site ceases immediately. Provisions that survive termination include Intellectual Property Rights, Limitation of Liability, and Indemnification.

13. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising under or related to these Terms shall be brought exclusively in the courts located in Toronto, Ontario.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ScanScope regarding your use of the Site and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.
